TERMS OF USE OF OCUPIX MEDIA FOR LONG TERM RENTAL (LTR) LISTINGS

All Photos and Media and rights relating to them, including copyright and ownership rights in the media in which the Photos and Media are stored, remain the sole and exclusive property of the Photographer, ocupix, and Todd A Phillips. This license provides the Client with the limited right to reproduce, publicly display, and distribute the Photos and Media only for promotional or advertising purposes directly related to the Lease of the Real Property at the listed address as a Long Term Rental only. Photos and Media used for any purpose not directly related to the Lease of the Real Property as a Long Term Rental must be with the express written permission of Photographer and the payment of additional fees, unless otherwise agreed to in writing. Photos and Media may be uploaded to any MLS listing service solely for promotion of the Property during the pendency of this Agreement. However, regardless of any terms and conditions of the MLS, at no time does this Agreement provide Client with the right to transfer copyright, or any other exclusive rights as provided by the Copyright Act 17 U.S.C § 106. Unless otherwise specifically provided elsewhere in this document or other signed agreement between the parties, any grant of rights is limited to a term of either one (1) year from the date of media delivery, or (2) ends at the termination of Client’s representation of the Property, whichever occurs first. Further use of images beyond one (1) year requires Photographer’s permission and additional fees. Photos and Media may NOT be used for the SALE or Short Term Rental, also known as Vacation Rental, of the property at anytime without the expressed written permission of the Photographer and additional Fees. Rights are assigned to the Client immediately upon delivery of the Photos. Additionally, Client may use the Media to promote their Real Estate Service business as long as they have an Active Listing using ocupix owned media or for a period of one year after the Client's most recent hiring and delivery of media from ocupix for any listing. Any use of media not permitted in the Terms of Use of ocupix media for Long Term Rental (LTR) listings, subjects the user to new charges for improper use of media. ALL Media items used improperly will be billed at a Useage Fee of $500 per item each calendar month the item(s) are used.
Payment instructions are delivered to the Client Via Email. Payment is required within 14 days of receipt of the Invoice or it will be considered LATE. If an invoice is unpaid past 14 days, Ocupix reserves the right to impose late Fees of up to 50% of the total invoice, at the start of each 30 Day period, every 30 Days until the invoice and all late fees are paid in full.
